Beyond the diversity of animals, of activities using animals and of
texts regarding them, the legal solutions aiming to protect animals have
contributed to the drawing of a legal image of the animal. However,
these legal provisions have elicited different interpretations. Doctrinal
differences are all the more important as the dispute over the status
of the animal is laden with moral choices. It goes beyond questions
of legal technique, although the latter should not be ignored. By discussing
the various legal theses present in the debate, in particular
the opposition between the subjectivist and objectivist currents, the
article seeks to highlight the dispute and to show that, in order to
resolve it adequately, it is also important to take into account the role
of law in the various modes of social regulation.
