In this contractual era, negotiation as a means of regulating the life of individuals and communities has developed so greatly that it may be asked whether the "unnegotiable" exists. In fact, technically, this idea plays an essential role in all negotiations where it is not only the possible stumbling-block, but from the point of view of what is at stake, it is also the hard core, or the heart of the matter. War and dissuasion furnish excellent examples. However, a study of the unnegotiable when examined as to its contents and its nature shows its relativity and fluidity. If individual unnegotiability exists its character is subjective and hinders its definition ; collective unnegotiability is unstable and fleeting. Lastly the key to the problem is legitimacy. If it disappears, if individual or social beliefs grow blurred, if the common interest becomes confused with private interest, then everything becomes negotiable.
