The virtues of the French system of examining magistrates

The inquisitory system as practised in France is often criticized by advocates of the anglo-saxon model (according to this view, it lacks respect for the rights of défendant and is too secretive). This ignores the profund upheaval that has taken place as weil as the advantages of the french system. An examining magistrate is better able to deal objectively with complex cases and to give equal considération to all parties. The system also reflects the deep french attachment to the tradition of the « Etat-arbitre ». Although it can be further improved it should not be
completely replaced by the anglo-saxon system.
