The contribution of the Constitutional Council to public law

For the last ten years public law has undergone profound changes due to the influence of the case law of the Constitutional Council. These changes which have not yet been perceived, manifest themselves, on the one hand, by an upheaval in the fondamental principles of public law : that of legality, hierarchy of rules and sources of law, and, on the other hand, by a tendency toward the reunification of public law based on the constitutional underpinnings which have developed and which from now on will significantly influence administrative law, civil liberties and public finance with ail the consequences resulting therefrom. In addition constitutional law having again become a basic principle of law as a result of its case law expression and henceforth more and more related to the international and EEC law, may no longer be taught in the same manner as before. Otherwise it will give an incomplete education in the current state of the law to future lawyers. Public law from the pre 1970 period has become historical public law.
