The Rights of the Opposition in France. Defining a Presidential Opposition

Without returning once more to the never-ending discussion about the
nature of the regime, it is nevertheless necessary to acknowledge that
the presidential function represents an obstacle to the improvement of
the constitutional status of the opposition unless the Head of State
approves it. This article intends to discuss the notion of a “presidential
opposition”, i.e. an opposition to the president at a time when the partisan
system is recomposing itself and the presidential office is reasserting
its power. Even if this idea is only an as yet unverified hypothesis,
it allows us to measure the huge gap that separates us from a real revalorization
of parliament as the place where the opposition would benefit
from rights it could exercise independently from the good will of
the majority.
