The Question of Unconstitutionality in Spain

Inspired in large part by the control of constitutionality as it has been
functioning for a long time in Italy and Germany, the question of unconstitutionality
in Spain bears a number of specific features compared to
the French one. It does not apply only to laws but, more generally to
all decisions that have force of law whoever is the author ; the norms of
reference are not only the rights and liberties guaranteed by the Constitution
but all constitutional provisions and certain particular laws ;
there is no screening by the Supreme judge since any judge can appeal
to the constitutional court ; the judge can do that at the parties’request
or ex officio ; in his referral ordinance he usually develops at length
the reasons that have led him to question the constitutionality of a
norm, giving thus rise to a fruitful dialogue with the constitutional
