The Priority Preliminary Ruling on the Issue of Constitutionality and the Italian Incidental Ruling on the Issue of Constitutionality : ab origine fidelis

The priority preliminary ruling on the issue of constitutionality is definitely
close to the Italian preliminary ruling. The identity between the
two systems comes from the hybridization of the control of constitutionality
of the law through the guarantee of subjective expectations
and the consequential dialectical relation between judges a quibus / constitutional
judges. Nevertheless, despite this communicability there are
differences and nuances in the choices made on both sides of the Alps
regarding the implementation of the mechanisms. These differences and
nuances apply to the introduction of an appeal on the issue of constitutionality
and the norms involved in the constitutional ruling. They
reflect the cultural traditions of the two states and their loyalty to the
origin of their systems.
