The Judge and Liberties

It seems natural, in a country like ours, that the judge should protect the
liberties of every individual, in particular against the established
powers. In fact, such an approach is the result of an historical accident
and, more precisely, of a certain understanding of Montesquieu’s ideas.
Indeed, the judge has no real legitimacy as guardian of liberties, and he
is not always very well armed to defend them efficiently. However, he
acts as best he can, and anyway, his action is irreplaceable.
