The Constitutional Council as Electoral Judge

Since 1958, the Constitutional Council has taken over the competence
of the electoral judge with regards to general and presidential elections.
Assigning such competence to an independent jurisdiction seems to be
a progress compared to the previous rule. However, the decisions of the
Constitutional Council regarding elections are often the target of criticisms
bearing either on the field of competence of the Council with
respect to that of the Council of state and the procedural judge, or on
the political nature of its control.
