Rights, Judges, and the Australian Conception of the Rule of Law

Loyalty to the principles of the British parliamentary system has long
delayed the advent of modern constitutionalism in Australia. In the
recent period, the High Court has significantly contributed to the
development of constitutional norms and to the protection of rights
and liberties. It has, thus, shaped an original form of the rule of law,
which combines the British notion of the rule of law to American
constitutionalism.
