France and Its Overseas Territories : Similar or Different Law ?

The law in France’s overseas territories is fundamentally characterized
by its ambivalence with regard to France and its judicial system.
Indeed, in some aspects, the two systems are similar, since the French
overseas territories are part of France ; but in other aspects, they are different,
since the French overseas territories are intrinsically overseas.
This dualism has clearly appeared since the March 28, 2003 Constitutional
revision, which attenuates the separation between the collectivities
ruled by article 73 of the Constitution and those ruled by article 74.
Overseas law illustrates the judicial pluralism of the French Republic.
