Against Positive Discrimination. Unbearable Freedom

Positive discrimination aims to redress the unequal situation of
groups seen as structurally disadvantaged by granting them a privileged
status. Defined as such, it presents a double inconvenient : first, it
reverses the hierarchy of privileges instead of suppressing it – thus
creating a feeling of constraint and injustice among those who are
excluded from the procedure –, second, contrary to its proclaimed
goal, it legitimizes the demands linked to ethnicity, religion or identity.
The principle of identity before the law is not an abstract value
but an operational concept, essential to the internalization of the social bond… A just policy of equality should not consist in creating positive
discriminations but in correcting, at the source, or on a case by
case basis, situations of negative discrimination.
