From its introduction, the priority preliminary ruling on the issue of
constitutionality has known a great success. The question is whether
this new and important litigation procedure is likely to impact the
Constitutional Council and to lead to some changes. The latter could
affect its organization, the status of its members, the strengthening of
its services, its procedure – both regarding electoral litigation or litigation
a priori –, its place within the ensemble of judges regarding
the screening role of the national Supreme courts, or the increasingly
urgent question of the proper articulation between constitutional law
and European law.
